Privacy Notice of Leather Club Tekstil ve Deri Turizm İnş. San. Tic. Ltd. Şti. Concerning the Protection of the Personal Data of Customers, Members and Visitors

Dear Visitors, Customers and Members,

As Leather Club Tekstil ve Deri Turizm İnş. San. Tic. Ltd. Şti. (“Leather Club”), acting in the capacity of “Data Controller” within the scope of the 6698 sayılı Kişisel Verilerin Korunması Kanunu (Law No. 6698 on the Protection of Personal Data) (the “Law”), we would like to inform you about our practices regarding the processing of your personal data and about the personal data we process.

This notice contains the privacy notice regarding the use of your personal data in the following cases:

  • Your visiting Leather Club stores or shopping at the Stores,
  • Your visiting the lcleatherclub.com website or using the Leather Club application that you download to your mobile phone,
  • Your shopping via the Website/Mobile Application or via the Contactless Payment system, or a purchase made by third parties being sent to you, or your becoming a member of the Website/Mobile Application,
  • Your consenting to the sending of general and personalized campaign notifications through commercial communication channels,
  • Our communicating with each other through communication channels,
  • Your contacting Leather Club and/or shopping in connection with corporate sales processes, or a gift, product, etc. being sent to you in connection with corporate sales processes,
  • Your participating in campaigns, contests, prize draws and other events organized by Leather Club,

1) What Are Our Purposes for Processing Your Personal Data and Which Personal Data Do We Process?

Store Visits

We process your security camera footage in order to ensure the safety of you, Leather Club and its employees and other third parties against any act, crime or behavior that may occur at the Stores in violation of legislation, and to fulfill our obligations to provide information and documents to judicial authorities and our other related obligations.

Store Purchases and After-Sales Processes

  • We process your identity (name and surname) and contact information (e-mail address, telephone number) and shopping information (date of purchase, amount, content of purchase, payment method and payment details) for the purposes of carrying out the shopping transaction, enabling the records we create for you in our system to be distinguished from records relating to other customers, enabling you to benefit from after-sales operational transactions (alteration, exchange, return, product inspection, etc.) without presenting an invoice/receipt and carrying out these operational transactions, enabling the e-invoice/e-archive invoice relating to your purchase to be sent to you, and procuring products not available in our stores to deliver them directly to you; and, in addition to this information, your Turkish ID number, for purchases that you will make by order from the Stores when the necessary conditions are met and for which you will subsequently make payment, in order to be able to exercise our legal rights in the event of a possible legal dispute,
  • In addition to the above, in the event that you make your purchase at our airport store, we process your passport number, nationality, date of birth, gender and flight information in order to fulfill our legal obligations,
  • Where necessary, we process your bank account information during return processes so that the refund can be made to your bank account,
  • We process your identity, contact and invoice information, and additionally, if you are a taxpayer, certain extra invoice information (Turkish ID/tax number, sole proprietorship information), for the purpose of issuing invoices and, in certain cases, carrying out current account and reconciliation transactions,
  • In the event that you wish to make your payment by credit card, we process your credit card information for the purpose of receiving the payment (credit card information is transferred to the payment institution without being recorded by us.)
  • In the event that you wish to make your payment by mail order, we process your name and surname, credit card information, telephone number, product information, order amount, signature and a photograph of the front side of your ID,
  • In the event that you wish to benefit from Leather Club’s personalized tailoring/product service, we process your name and surname, order information and the body measurement information relating to your order, and also, if you give your explicit consent, this listed information for the purpose of using it in orders you will place in the future and storing it so that your body measurements are not taken again with each order,

  • We process your marketing information (date of birth, gender, province, district, demographic information, location information if location sharing is enabled, attitudes towards in-Website and in-Mobile Application notifications/surveys/offers/campaigns, habits, favorites, likes, behaviors, preferences, search activity, segments, past purchases, cookie records, cookie and advertising identifier/ID information and device ID, payment methods and preferences, Mobile Application usage duration, Mobile Application version information, communication preferences, purchase amount, payment channels, information about the bank where the payment was made, the brand, model, technical specifications and operating system information of the device used, your operator information, survey responses, etc.) for the purposes of creating general or personalized campaigns, advantages, promotions and advertisements, organizing campaigns, contests, prize draws and other events, carrying out segmentation, reporting, profiling, marketing and analysis activities, and conducting Leather Club’s advertising and marketing/communication activities (notifications, pop-up displays, personalized offers, customization of user screens, advertising, search, surveys, etc. on the Mobile Application and Website) on the Mobile Application, the Website or other third-party environments,

Website/Mobile Application Use and Website/Mobile Application or Contactless Payment Purchases (As a member or without membership)

In the event that you use the Website/Mobile Application or wish to place an order via the Website/Mobile Application or via our Contactless Payment system,

  • We process your identity (name and surname) and contact information (e-mail address, telephone number, address) and shopping information (date, time, amount, content of purchase, payment method and payment details) for the purposes of carrying out the shopping transaction, preparing the order, packaging, preparing the dispatch note, shipping, updating delivery information, delivering your order to you or, in the event that you wish to collect your order from the Stores, providing delivery appropriately at the Stores, enabling the records we create for you in our system to be distinguished from records relating to other customers, carrying out after-sales operational transactions (alteration, exchange, return, product inspection, etc.), and enabling the e-invoice relating to your purchase to be sent to you,
  • We process your identity and invoice information, and additionally, if you are a taxpayer, certain extra invoice information (Turkish ID number, tax number, sole proprietorship information), for the purpose of issuing invoices,
  • In the event that you wish to make your payment by credit card, your credit card information for the purpose of receiving the payment (credit card information is transferred to the payment institution without being recorded by us.)
  • In the event that a product is sent to you by persons via the Website/Mobile Application, we process your name and surname, mobile phone and address information for the purpose of delivering the order to you.
  • We process your information regarding the use of the Website and Mobile Application in order to detect and remedy technical/software errors and deficiencies encountered during your visit to and use of the Website and Mobile Application,

Website Membership (Website/Mobile Application)

  • We process your identity (name and surname), contact (e-mail address, telephone number) and password information for the purposes of carrying out membership transactions, fulfilling the requirements of the membership agreement we will conclude with you, enabling member login and providing membership notifications,
  • We process your identity (name and surname) and contact (telephone number, e-mail address, delivery and invoice address information) information so that, when you wish to shop via the Website/Mobile Application as a member, you can shop using your member information without having to enter information again with each shopping transaction,
  • We process your shopping information (date, time, amount, content of purchase, payment details) in order to provide you, as a member, with a service to view your order history,
  • We process your shopping information regarding the purchases you make from stores and the Website so that you can benefit from special membership programs, benefit from personalized opportunities and offers created based on the purchases you make from stores and the Website, earn points and use these points; and we process your marketing information (date of birth, gender, province, district, demographic information, location information if location sharing is enabled, attitudes towards in-Website and in-Mobile Application notifications/surveys/offers/campaigns, habits, favorites, likes, behaviors, preferences, search activity, segments, past purchases, cookie records, cookie and advertising identifier/ID information and device ID, payment methods and preferences, Mobile Application usage duration, Mobile Application version information, communication preferences, purchase amount, payment channels, information about the bank where the payment was made, the brand, model, technical specifications and operating system information of the device used, your operator information, survey responses, etc.) for the purposes of creating general or personalized campaigns, advantages, promotions and advertisements, organizing campaigns, contests, prize draws and other events, carrying out segmentation, reporting, profiling, marketing and analysis activities, conducting Leather Club’s advertising and marketing/communication activities (notifications, pop-up displays, personalized offers, customization of user screens, advertising, search, surveys, etc. on the Mobile Application and Website) on the Mobile Application, the Website or other third-party environments, creating and conveying to you the nearest and most suitable offers if location sharing is enabled on your mobile device, and improving the user experience on the Website and Mobile Application,

Corporate Sales Processes

In the event that you contact our corporate sales unit, we process your identity (name and surname), contact (e-mail, mobile phone), customer transaction (offer, order, shipping information), invoice information and the information of the institution you work for, for the purposes of preparing your offer upon your request, conveying it to you, conveying your information to the relevant store if you accept the offer, sending your products to you, and communicating where necessary and in connection with new order processes. (The information to be processed in connection with your order is set out above in the section relating to store purchases.)

In the event that a gift, product, etc. is sent to you by third parties within the scope of corporate sales processes, we process your name and surname, mobile phone, address and the information of the institution you work for, for the purpose of delivering the order to you.

Call Center/Customer Relations Processes/Live Style and Sales Consultancy

In the event that you contact us through our communication channels (call center, e-mail, Website, Mobile Application, social media, online messaging/voice call application, etc.), we process your identity (name and surname), contact (address, e-mail address, telephone number), customer transaction (your appointment information, your requests and complaints, your purchases, gift/discount/benefit usages) information, visual records (photographs, videos and video call recordings) if they are contained in the messages you convey or if you participate with your camera on in a video call within the scope of the live consultancy service to be provided to you, and, where necessary, your legal transaction information, in order to resolve the problems and complaints you convey to us, answer your questions about fashion and style, contact you in connection with these where necessary, and provide online video style and sales consultancy services from Leather Club stores in line with the appointment you create; we also process video call video recordings and call center voice recordings to be used as evidence in our customer satisfaction efforts and in disputes that may arise between us.

Legal Processes and Internal Activities

We process your identity, contact, shopping, invoice and transaction security (log records) information for the purposes of fulfilling our obligations arising from legislation and fulfilling our other legal obligations to authorized and competent public institutions and organizations.

We process your identity (name and surname), contact (telephone number, e-mail address, address), shopping, invoice, camera footage, transaction security information (log records relating to permission/explicit consent/agreement approval within the scope of Website membership, Website/Mobile Application purchases, commercial communication) and legal transaction information (correspondence and file information relating to dispute processes) for the purposes of exercising every kind of right to bring an action, to respond and to object against official institutions and organizations such as courts, enforcement offices and arbitration boards in disputes that may arise, conducting negotiation and settlement processes relating to disputes, conveying the necessary information to you in the event that you request information from us, and within the scope of internal audit, internal control and reporting, testing, development and improvement activities.

We process your identity, contact, credit card information (only the first 6 and last 4 digits), shopping and order information and transaction security information in order to prevent the use of the Mobile Application, Website and other Leather Club systems in a manner contrary to membership agreements, legislation and morality, to detect suspicious transactions and unlawful uses, and to perform blocking and unblocking transactions.

2) To Whom and for What Purpose May We Transfer Your Personal Data?

We share your personal data,

  • With our company’s domestic service providers and business partners (call centers, those who collect personal data through devices, marketing/advertising/analysis service providers, database and server service providers, those providing services to monitor Website and Mobile Application usage, e-mail server service providers, e-invoice and e-archive invoice service providers, electronic message intermediary service providers, cargo and courier firms, suppliers providing custom product tailoring services, card printing service providers, printing houses, warehouse service providers, banks and electronic payment institutions, legal and financial consultancy service providers, independent audit service providers, archiving service providers, customer support - video call service providers and online messaging/voice call service providers) for the purposes of obtaining product and service support in matters such as information technologies, marketing/advertising/analysis activities, logistics services, payment services or consultancy requiring expertise, etc.,
  • With the aforementioned institutions, organizations and authorities, providing the information requested from us, for the purposes of fulfilling our obligations to provide information and documents and our other related obligations to authorized public institutions and organizations and judicial authorities, and exercising our legal rights such as the rights to bring an action and to respond,
  • With our suppliers from whom we receive consultancy services where necessary and with the payment institutions relating to the relevant transaction, for the purposes of monitoring and detecting suspicious transactions and preventing unlawful transactions,
  • With the security units of the shopping center where the store is located, your security camera footage in the stores where necessary,
  • With our business partners within the scope of activities relating to increasing visit traffic on the Website and Mobile Application,
  • Transfer Abroad: We share your identity, financial, contact, marketing, location, customer transaction and transaction security data abroad, with service providers located abroad (insurance services within the scope of cyber security, server/maintenance and development services) for the purposes of obtaining product and service support in matters such as information technologies, marketing/advertising/analysis activities, or consultancy requiring expertise, etc., and with business partners in order to fulfill the requirements of the agreements within the scope of the agreements we make with our business partners, and thereby because the servers of the relevant domestic and/or foreign suppliers are located abroad,

3) What Is the Method and Legal Basis of Collecting Your Personal Data?

We collect your personal data by Leather Club, its affiliates, suppliers or business partners; through automatic methods such as: the security cameras located in the Stores; the recording into our systems by sales consultants of the information you verbally declare to them at the Stores; the recording into our systems of the information you share regarding the purchases or membership transactions you make through the Stores, the Website or the Mobile Application; the recording into our systems of data generated/obtained from the use of your fixed-mobile internet and communication devices and/or mobile applications in various environments and places; the collection of your location data by beacon devices located in our Stores or by the Mobile Application in the event that you are a Website Member and location sharing is enabled in the Mobile Application and/or the bluetooth feature is enabled on your mobile device; the recording into our systems of your requests regarding the products you wish to order within the framework of the Contactless Payment system and the information necessary for the order which you communicate to our employees through various communication channels (such as telephone calls and e-mail); the recording into our systems of every kind of purchase, collection, delivery, transaction, survey completion, registration and behavioral transactions on the Store, Website and Mobile Application; the recording of the redirection transaction made to the Website and Mobile Application from our business partners’ websites; cookies and other similar technologies operating on the Website or Mobile Application as explained in detail in the cookie policy; the recording of the requests and complaints and your questions about fashion and style that you have conveyed to us during mutual communication through the call center, Mobile Application, Website, our e-mail addresses, social media and other communication channels; the recording of the video calls you make within the scope of the live style and sales consultancy service; the recording of the calls you make with the call center; the updating and enrichment by Leather Club of the data you share in the event that you give explicit consent within the scope of Website membership; and through non-automatic methods such as: the recording of information/documents about you received from official institutions, organizations and judicial/administrative authorities; the recording of your mail order forms; and the recording of the relevant documents and records relating to your special order processes or return processes.

We collect your personal data based on the legal grounds of “the necessity of data processing for the establishment and performance of a contract”, “the fulfillment of a legal obligation” and “the necessity of data processing for the legitimate interests of the data controller” in connection with the sales processes on the Website, Stores and Mobile Application; on the legal ground of “the fulfillment of a legal obligation” regarding our storage obligations arising from legislation; on the legal grounds of “the necessity of data processing for the legitimate interests of the data controller” and “the necessity of data processing and transfer for the establishment, exercise or protection of rights” regarding the recording made by security cameras in stores; on the legal grounds of “the necessity of data processing for the establishment and performance of a contract” and the “explicit consent” you will give regarding the Website Membership processes; on the legal grounds of “the necessity of data processing for the establishment and performance of a contract” and “the necessity of data processing for the legitimate interests of the data controller” regarding the Call Center/Customer Relations Processes/Live Style and Sales Consultancy processes; and based on the “explicit consent” you will give in the event that you request that your information be stored in commercial communication processes or special order processes. You may at any time and without giving any reason withdraw your explicit consent and thereby terminate the personal data processing activities based on explicit consent.

When you visit our website, even before you state your cookie preference and without any cookie being placed on your device, anonymous/cookieless technical data (such as your IP address, browser and device information, and the page visited) may be processed for the purposes of measurement and advertising-conversion modelling, and this data may be transferred to our measurement/analytics service provider whose servers are located abroad. Cookies and personalised measurement operate only if you give your explicit consent through our cookie notice; if you do not consent, only this cookieless, anonymous measurement continues, and your right to refuse is reserved at all times.

4) What Are Your Rights?

You may at any time apply to us regarding your rights set out in Article 11 of the Law in connection with the personal data we process. You may submit your applications by making a written application to the address specified below of Leather Club Tekstil ve Deri Turizm İnş. San. Tic. Ltd. Şti. as the Data Controller, or by sending an e-mail from the e-mail address registered in our system. (We would like to remind you that the relevant request must comply with the conditions set out in the Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ (Communiqué on the Procedures and Principles of Application to the Data Controller).)
